Commercial Drivers and DWI

Commercial vehicle drivers who are intoxicated put many people at risk. Commercial vehicles are meant for highly specialized tasks and are less maneuverable when compared to passenger vehicles. In addition, commercial drivers are often charged with transporting hazardous materials. Due to the risks attached to commercial vehicles, almost all aspects of the industry are regulated by federal government. This includes licensing of drivers. According to the regulations of the Federal Motor Carrier Safety Administration (FMCSA), drivers of commercial vehicles are limited to .04 blood alcohol content. Furthermore, commercial drivers license holders who are found to have operated any kind of vehicle while intoxicated by alcohol or drugs are disqualified from operating commercial vehicles for one year. If the driver operates a vehicle that transports risky or hazardous materials, the disqualification period is three years. Other offenses that could result in being disqualified from operating a commercial vehicle are:

Refusing to undergo a breath or blood test
Operating a commercial vehicle with a blood alcohol content that is above .04
Operating a vehicle while intoxicated by alcohol or drugs
Fleeing from the scene of an accident
