If you dont take the breath or blood test when requested, your license will be immediately taken away for up to 180 days. If you submit to the test, and have a blood alcohol content of .08 or greater, you could face a 90 day suspension of your drivers license. The 180 day suspension is separate from the 90 day suspension. If however, your attorney does not request an Administrative License Revocation hearing within fifteen days of your arrest, the state will not revoke your license and you will lose your right to drive in Texas and possibly in your home state if you dont live in Texas.
